1. Acceptance of Terms

By accessing or using Towji (towji.com and related services, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Towji provides an AI-assisted platform to help users locate and recover towed vehicles. Our services include vehicle search assistance, towing company information, cost estimates, and recovery guidance. The Service is provided "as is" and "as available" without warranties of any kind.

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for:

  • Maintaining the confidentiality of your account and password
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Ensuring your account information remains accurate and up-to-date

4. Acceptable Use

You agree not to use the Service to:

  • Violate any laws or regulations
  • Infringe on the rights of others
  • Transmit harmful, offensive, or illegal content
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Use automated systems to access the Service without permission
  • Collect or harvest user data without consent

5. Intellectual Property

The Service and its original content, features, and functionality are owned by Towji and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

6. Payment Terms

For paid services:

  • Mobile prices are displayed in the app and the applicable app store before purchase and may vary by country, currency, tax, or store pricing rules.
  • When the iOS app is available, its subscriptions are processed through Apple In-App Purchase.
  • When the Android app is available, its subscriptions are processed through Google Play Billing, with RevenueCat used to manage purchase entitlements.
  • Mobile subscriptions auto-renew until canceled through your Apple ID or Google Play subscription settings. Deleting your Towji account does not cancel an active store subscription.
  • Web access is available for $24.99 per month or $99.99 per year, billed in USD. Subscriptions renew until canceled. Cancel renewal through your account to retain access through the paid period. Towing and storage fees are separate.
  • Stripe processes web payments. Towji does not store full card numbers or card security codes.
  • Payment is due at the time of purchase.
  • Fees are non-refundable unless required by law or stated otherwise at checkout.
  • We may change pricing for future purchases with notice in the product or checkout flow.

6A. Optional Text Alerts

Towji Vehicle Discovery Alerts are optional recurring automated tow-result notifications. If Towji makes the program available to your account and you enroll after verifying your phone number, you expressly consent to receive transactional text messages at the mobile number you provide. SMS consent is not a condition of purchase or use of the Service.

  • Message frequency varies with your monitoring activity and matched vehicle-discovery events.
  • Message and data rates may apply.
  • Reply STOP to cancel and HELP for help.
  • You may also revoke consent in Towji settings.
  • Support is available at support@towji.com.
  • Carriers are not liable for delayed or undelivered messages.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee the accuracy, completeness, or usefulness of any information on the Service.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOWJI.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless Towji, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, and expenses, including reasonable attorney fees, arising from your use of the Service or violation of these Terms.

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately. All provisions that should survive termination shall survive.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any legal action or proceeding shall be brought exclusively in the courts located in Travis County, Texas.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide notice prior to any new terms taking effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised terms.
